How to File a Consumer Complaint in Delhi

The Consumer Protection Act, 2019 provides an accessible mechanism for individuals to seek redress for defective goods, deficient services, and unfair trade practices. Delhi has dedicated Consumer Disputes Redressal Commissions at the district level across the city. This article outlines the process for filing a complaint before the District Consumer Commission in Delhi.

Who Is a Consumer?

Under the 2019 Act, a consumer is any person who buys goods or avails services for personal use and not for commercial resale. The Act also covers online transactions and brings e-commerce within its ambit expressly.

What Can You Complain About?

  • Defective goods — where the product suffers from a manufacturing defect or does not conform to the represented standard.
  • Deficiency in service — where the service provider fails to deliver the contracted service to the required standard (banking, insurance, hospital, builder, telecom, etc.).
  • Unfair trade practices — misleading advertisements, false representations, bait-and-switch pricing.
  • Charging excessive prices or prices higher than the displayed price.
  • Hazardous goods or services that pose a risk to safety.

Which Commission to Approach?

Jurisdiction is determined by the value of the complaint (goods/services value plus compensation claimed):

  • District Consumer Commission: Claims up to ₹50 lakhs.
  • State Consumer Commission (Delhi): Claims between ₹50 lakhs and ₹2 crores.
  • National Consumer Commission (NCDRC): Claims above ₹2 crores.

You file before the Commission within whose territorial jurisdiction the opposite party (business) resides, carries on business, or where the cause of action arose.

Step-by-Step Filing Process

Step 1: Send a Legal Notice

Before filing, send a written demand notice to the opposite party by registered post, giving them an opportunity to remedy the deficiency. Keep a copy of the notice and the postal receipts. While not mandatory, this often resolves disputes without litigation and demonstrates good faith to the Commission.

Step 2: Prepare the Complaint

The complaint must be written and should include:

  • Full details of the complainant and opposite party
  • Facts of the transaction (date, amount, nature of goods/services)
  • Description of the defect or deficiency
  • Documents in support (receipts, invoices, warranty cards, correspondence)
  • Relief sought — refund, replacement, compensation, removal of deficiency
  • Affidavit verifying the complaint

Step 3: Pay Court Fees

Court fees are payable on a nominal scale based on the value of the claim, and are significantly lower than fees in civil courts. Fee schedules are available at the Commission's office.

Step 4: File and Attend Hearings

File three copies of the complaint — one for the Commission, one for service on the opposite party, and one for your record. On the first hearing, the Commission will assess if the complaint is in order. The opposite party is then given notice and required to file their response.

Time Limit

A complaint must be filed within two years from the date the cause of action arose. The Commission can condone delay if sufficient cause is shown, but delays can adversely affect your case and the freshness of evidence.

What the Commission Can Order

If the complaint is proved, the Commission can order: refund of the amount paid with interest, repair or replacement of defective goods, removal of deficiency in service, compensation for loss or injury suffered, and punitive damages where the opposite party's conduct was deliberate or unconscionable.
